CRITERIA FOR ALLOCATION OF THE FUND FOR THE FILM AND AUDIOVISUAL SECTOR, WHICH IS PROVIDED FOR BY ART. 21, PAR. 4 OF PROVINCIAL LAW NO. 15 DATED 3 OCTOBER 2007

Film Fund


1. PURPOSES OF THE FUND

1. The Province promotes and supports the film and audiovisual sector, in compliance with European regulations, in order to promote the provincial area and the development of local professional, technical and artistic resources. This is done in ways that include the creation of a dedicated fund and sponsoring a special Film Commission, hereafter called TFC (Trentino Film Commission), which is named by the provincial Executive Committee.


2. The fund is set aside to:

a) support the creation and dissemination of audiovisual works in order to attract film, television and documentary productions to the provincial area that favor the development of employment and the Trentino economy, and in order to promote local tourism and the geographical, environmental, cultural, and historical heritage of the province of Trento;

b) promote the development and training of professional, technical and artistic human resources in the province of Trento, in order to improve the competitiveness of the local audiovisual industry;

c) sustain decentralized showings of films, with particular emphasis on quality productions;

d) pay the expenses for operating the Trentino Film Commission.


2. ALLOCATION OF THE FUND

1. The fund is allocated for:

a.     paying the direct expenses involved in the operation of the Trentino Film Commission. These expenses are incurred for:

-    creating computer and archival tools for structuring and maintaining databases of locations, professionals, photographs and other associated items;

-     providing assistance to productions;

-    preparing, printing and distributing promotion and publicity materials;

-     promoting the activities of the Trentino Film Commission when festivals and market fairs in the sector are held;

-    carrying out study projects and descriptive investigations related to the activities of the Trentino Film Commission and the relative benefits to the economic/employment and promotional system in the provincial area;

-    holding seminars for promoting and developing local film and audiovisual production;
-  working jointly with other agencies when holding events within and outside the province that relate to the purposes of the Trentino Film Commission;

     -  implementing institutional collaboration with Italian and international film organizations.

b. funding film and television productions, local, national and international documentaries, and original television formats; and supporting participation in training programs and in professional contests, festivals or markets, based on the criteria indicated below. Support for participation in training programs and in professional contests, festivals or markets is provided to professionals and operators in the sector, with particular emphasis on young professionals and on film and audiovisual productions.

2. On an annual basis, with a measure taken by the Provincial Executive committee, the fund is divided up for paying the direct expenses specified in letter a) and for the project funding specified in letter b). In the same measure, it is likewise noted that if the portion of the fund set aside for direct expenses is not completely used, the monies set aside for project funding will be increased.


3. RECIPIENTS OF THE FUNDING

1. The following may submit an application for funding of projects as described in point 2, letter b):

a) independent audiovisual production companies - in Italy, in EU-member countries, and outside the EU (hereafter called “Film and television productions”) - for creating works in the province of Trento that are intended for cinema, television, multimedia and home video distribution, both in Italy and internationally;

b) independent audiovisual production companies - in Italy, in EU-member countries, and outside the EU (hereafter called “Documentary productions”) - for creating audiovisual works in the province of Trento, especially those of a documentary nature and/or intended for the New Media;

c) independent audiovisual production companies and local professionals - who were born in the province of Trento or have resided there for at least one year (hereafter called “Local productions”) - for developing audiovisual works in the province of Trento, in Italy and abroad, especially those of a documentary nature and/or intended for the New Media;

d) Local professionals - who were born in the province of Trento or have resided there for at least one year - for participating in training programs and professional contests, festivals or markets in the sector, both in Italy and abroad, in order to develop competence as well as co-production and distribution relationships with other players in the sector;

e) Local television editors, for conceiving and developing new, original drama productions and television formats of a non-journalistic nature.

2. Funding will not be granted for films that constitute advertising, are racist in character or contrast with public morals and decency, or which have been commissioned by other provincial organizations or operating organizations.

3. Those receiving funding for a project may not receive grants from other provincial organizations or grants provided for in other provincial laws dealing with this sector.


4. METHODS AND DEADLINES FOR SUBMITTING APPLICATIONS FOR FUNDING

1. Those interested must submit the application for funding which has been specially prepared by the provincial administration and is available at www.modulistica.provincia.tn.it and at the Printing Office of the Province.
2. Applications for funding can be submitted at any time in the following ways:

delivery by hand;
mailing: applications must be sent by registered mail with return receipt. When the application is mailed, the stamp of the accepting post office (or the stamp of the courier company, if the application is sent by courier) will determine the eligibility of the application for the grant;
submission by fax or e-mail, in compliance with applicable regulations on digital administration.


5. DOCUMENTATION TO BE SUBMITTED WITH THE APPLICATION FOR FUNDING

1. Productions and Local television editors must submit the following documentation together with the application for funding:

a) the subject and screenplay of the work;

b) resumes of the producer, director, main actors and distributor;

c) a list of the crew and the cast, from which it can be determined that:
for Film and television productions: during the period of shooting in the Trentino area, at least 20% of the crew (excluding extras) are technical and/or artistic specialists who were born in the province of Trento or have been residents there for at least one year;
for Documentary productions: during the period of shooting in the Trentino area, at least two technical and/or artistic specialists (excluding extras) are included who were born in the province of Trento or have been residents there for at least one year; or, the production is a co-production with a local audiovisual company;
for Local television editors: at least 50% of the requested funding is used for activities performed by independent companies that have had their registered offices in the Province of Trento for at least one year, or by technical and/or artistic specialists (excluding extras) who are not working for the TV station, and who were born in the Province of Trento or have been residents there for at least one year.

d) a detailed estimate of the purchases that will be made in the province of Trento, from which it can be determined that:
for Film and television productions: expenditures totaling at least 150% of the requested funding are planned in the province of Trento, excluding expenses for personnel with permanent jobs and expenses for investment;
for Documentary productions: expenditures totaling at least 120% of the requested funding are planned in the province of Trento, excluding expenses for personnel with permanent jobs and expenses for investment;
for Local productions: expenditures totaling the entire amount of the requested funding are planned, regardless of where the work is shot;
for Local television editors: expenditures totaling the entire amount of the requested funding are planned, regardless of where the work is shot.

e) a projected financial plan for the entire initiative/project, from which it can be determined that the total funding requested does not exceed 50% of the gross cost of the work (including all production expenses, general expenses, producer fees and financial expenses), and that said requested funding - taken together with other planned financing (if any) - does not exceed the total cost of the work;

f) contracts and/or agreements for co-production, distribution or broadcast of the film, if stipulated;

g) an affidavit attesting to any de minimis aid received during the previous two fiscal years and during the current fiscal year;

h) for Local television editors only: a detailed, thoroughly elaborated plan regarding the drama series, the proposed formats, and air times;

i) a declaration committing the applicant to reporting every important variation from the information contained in the submitted documentation.

2. Together with the application, local professionals must present the following documentation when making requests for grants for Training:

a) the professional resume of the applicant and/or the resume of the local audiovisual production company;

b) detailed documentation on the training program and the professional contest, festival or market in the sector;

c) an estimate of documentable costs, from which it can be determined that the amount of funding requested does not exceed 50% of total documentable costs;

d) a declaration committing the applicant to reporting every important variation in the information contained in the submitted documentation.

3. If the recipients are listed on a register of companies, the competent provincial organization will acquire the necessary data and information by directly accessing the databanks at the Chamber of Commerce. If the potential recipient is a company whose registered address is in another EU-member country or a country outside the EU, the legal representative must submit the company’s identifying information, along with an affidavit or equivalent document which states that the applicant is enrolled at an institution that is analogous to the Chamber of Commerce in the country where the company is based.

4. If the recipient is not a company, it must submit a non-certified copy of its Articles of Incorporation and Bylaws, or other documentation that contains the same information required of companies, in addition to the documentation specified in the previous paragraphs.

5. Funding is provided in compliance with EU regulations governing state aid.


6. AMOUNTS OF FUNDING

1. The following are the maximum amounts of funding available:

a) for Film and television productions - up to a maximum of 200,000 euros

b) for Documentary productions - up to a maximum of 40,000 euros

c) for Local productions - up to a maximum of 60,000 euros

d) for Training or professional marketing projects - up to a maximum of 10,000 euros

e) for Local television editors - up to a maximum of 100,000 euros

 

 7. CRITERIA OF EVALUATION

The Trentino Film Commission evaluates the projects it receives according to the criteria described below.

Different criteria are used, depending on the prospective recipient. As indicated below, each criterion is assigned a percentage value and a numerical value. Funding - within the limits of the available resources in the fund - is provided to projects that have totaled at least 70 points out of 100.


- for Film and television productions, the following factors are considered:

a) nature of the subject (10% - 10 points max.)

b) credentials of production staff, author, director, actors (20% - 20 points max.)

c) the number of weeks of preparation, shooting and post-production that are planned, and direct economic benefits to the provincial area (20% - 20 points max.)

d) the ability to enhance and promote tourism in the province of Trento and its geographical, environmental, cultural, and historical heritage (30% - 30 points max.)

e) distribution agreements contained in contracts or other documentation (20% - 20 points max.)


- for Documentary productions, the following factors are considered:

a) nature of the subject (10% - 10 points max.)

b) credentials of production staff, author, director, actors (10% - 10 points max.)

c) the ability to enhance and promote tourism in the province of Trento and its geographical, environmental, cultural, and historical heritage (20% - 20 points max.)

d) direct economic benefits to the provincial area (20% - 20 points max.)

e) innovation and experimentation in style and format (10% - 10 points max.)

f) co-production agreements with local, national and/or international companies (10% - 10 points max.)

g) prospects for distributing the work and (if signed) distribution agreements (20% - 20 points max.)


- for Local productions, the following factors are considered:

a) nature and development level of the subject (10% - 10 points max.)

b) credentials of production staff, author, director, actors (10% - 10 points max.)

c) innovation and experimentation in style and format (10% - 10 points max.)

d) co-production agreements with local, national and/or international companies (10% - 10 points max.)

e) prospects for distributing the work and (if signed) distribution agreements (20% - 20 points max.)

f) certificates of participation in professional markets, pitching, and national and international contests (20% - 20 points max.)

g) direct and/or indirect economic benefits to the provincial area (20% - 20 points max.)


- for Training and professional marketing projects, the following factors are considered:

a) credentials of the applicant (30% - 30 points max.)

b) the value of the training program or professional marketing activity; also taken into consideration is the resume of the participant or type of work used (40% - 40 points max.)

c) the cost/effectiveness relationship of the project (30% - 30 points max.)


- for Local television editors, the following factors are considered:

a) nature of the subject (10% - 10 points max.)

b) credentials of the editor (10% - 10 points max.)

c) the ability to enhance and promote tourism in the province of Trento and its geographical, environmental, cultural, and historical heritage (20% - 20 points max.)

d) innovation and experimentation in style and format (30% - 30 points max.)

e) co-production agreements with local, national and/or international companies (20% - 20 points max.)

f) direct economic benefits to the provincial area (10% - 10 points max.)


8. TERMS OF EXECUTION - ACCOUNTING

1. The terms for executing and providing accounting for the projects are as follows:

Starting deadline: 9 months from the date when the grant is offered;
Deadline for completion and full accounting of the project: 2 years from the starting deadline

2. Extensions may be granted upon submission of a request containing the reason(s) for the extension, according to the terms of and within the limits expressed in resolution no. 1980 of the Provincial Executive Committee, dated 14 September 2007.

3. If the project is not begun within nine months from the date when funding is offered, the latter will be revoked.
If the deadline for completion and accounting of the project is not met, or if an examination of the accounting reveals that the obligations of the recipient have not been fulfilled, the funding will be totally revoked or partially revoked in proportion to the activity reported on the accounting/carried out.

4. In addition to the accounting for both the portion of the project carried out in the provincial area and the project as a whole, the documentation specified in the Decree of the President of the Provincial Executive Committee no. 9-27/Leg… dated 5 June 2000 must be submitted. Furthermore:

- the recipients of funding for production must document (even with an affidavit) the use and compensation of local professional, technical and artistic human resources and/or any co-production agreements with local companies;

- the recipients of funding for training must submit an affidavit attesting to payment for enrollment and participation in the training course or professional event/market.


9. GRANTING OF FUNDING
 
The Trentino Film Commission, which meets every three months, evaluates the applications it receives and proposes a list of qualified candidates for approval by the competent body.

The competent body, with a measure of its own, approves the list proposed by the Trentino Film Commission and grants funding within the budgetary limits of the fund. Said measure is passed within 30 days from the date that the Trentino Film Commission meets.

Applications for projects that have been positively evaluated and admitted for funding but have not been funded because the funds have been exhausted will have priority if additional funds are appropriated. Funding for these projects will be based on the number of points assigned to them.

A list of the recipients of funding will be published on www.trentinofilmcommission.it. Recipients will be notified by ordinary mail.


10. DISBURSEMENT OF FUNDING

1. The funding will be disbursed in the following ways:

a) for all recipients: 30% as an advance payment when the application for funding is approved; said payment will be made upon submission of a surety bond for the amount of the payment;

b) for Film and television productions, Documentary productions, Local productions and Local television editors, for works created in the province of Trento: 50% after the accounting is submitted for the expenses incurred in the local area;

c) for Film and television productions, Documentary productions, Local productions and Local television editors: the remaining 20% after the general accounting is submitted;

d) for Local productions and Audiovisual editors who operate outside the province of Trento: the remaining 70% after the general accounting is submitted;

e) for recipients of grants for Training: 70% after the accounting for the training course or professional event/market is submitted.


11. ADDITIONAL OBLIGATIONS OF RECIPIENTS

Film and television productions, Documentary productions, Local productions and Local television editors must fulfill the following additional obligations:

a) including a thank-you (with logo, where required) to the “Autonomous Province of Trento” and the “Trentino Film Commission” in the closing credits of all audiovisual works and each episode of a film series, said thank-you to be the first of its kind in the credits;

b) including the wording, “in cooperation with the Trentino Film Commission” in the opening titles of the productions, as agreed upon with the Province;

c) including the wording, “in cooperation with the Trentino Film Commission” on all information, advertising and promotional materials for the work, unless otherwise agreed upon between the parties;

d) allowing a press conference to be held in the provincial area, with participation of the director and the main actors, as well as officials from the TFC and public officials, without the selection or exclusion of any media representatives, unless otherwise agreed upon between the parties;

e) providing the Province free-of-charge with at least 5 photos of scenes, to be chosen by the Trentino Film Commission, and allowing an operator assigned by the Province to take photos of scenes and backstage photos during at least one day of shooting, unless otherwise agreed upon between the parties;

f) providing - within one year from the date of public presentation - a copy on digital media of the work created with funding granted pursuant to Provincial Law 15/07, said copy to be deposited at the Format -Audiovisual Center of the Autonomous Province of Trento, with rights to non-commercial use, unless otherwise agreed upon between the parties;

g) authorizing a representative of the TFC to be present on the set at the times and in the ways that are agreed upon.
